Consumer dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

1. Controller

Studio Treo, Tobias Affüpper, Feldstraße 12, 40721 Hilden, Germany Email: tobias@treo.studio We are not required to appoint a data protection officer.

2. Hosting

This website is hosted by Netlify, Inc. (USA). When you open a page, Netlify processes technically necessary data such as your IP address, the time, the address requested, the referrer and the browser identifier (user agent) in server logs, to deliver the page and protect it against attacks. The legal basis is Art. 6(1)(f) GDPR (our legitimate interest in providing the website securely and reliably). Transfers to the USA rely on the EU-US Data Privacy Framework or standard contractual clauses.

3. Audience measurement with Pirsch

We use Pirsch Analytics by Emvi Software GmbH (Germany) to count anonymously how often our pages are visited. Pirsch sets no cookies and creates no profiles. A hash that changes daily and cannot be reversed is formed from the IP address and the browser identifier; the IP address itself is not stored. The data is processed on servers in Germany. The legal basis is Art. 6(1)(f) GDPR (our legitimate interest in a data-saving analysis of use).

4. Cookies, fonts and scripts

This website sets no cookies. Fonts, stylesheets and scripts are loaded directly from our server; there is no connection to external font or code providers. The only exception is the Pirsch script (see section 3).

5. Contact by email

If you email us, we process your details to answer your request (Art. 6(1)(b) or (f) GDPR). We delete them once they are no longer needed for this and no statutory retention periods apply.

6. External links

Our projects link to external websites. Data is only transferred to the provider concerned once you click such a link. That provider alone is responsible for its processing of data.

7. shadr

shadr is our shader editor in the browser (shadr.treo.studio), together with the app “shadr for Mac”. The following also applies to both:

Editor on shadr.treo.studio

Like this website, shadr.treo.studio is hosted by Netlify (see section 2) and uses Pirsch (see section 3). There, besides page views, Pirsch records single actions in the editor (for example an export) and clicks on the download of shadr for Mac, without the content of your shaders. The editor stores your own shaders, presets and settings in your browser’s local storage (localStorage). They do not leave your device unless you create a link to a look, and they are strictly necessary for the function (Section 25(2) No. 2 TDDDG). You can delete them at any time in your browser’s settings.

Links to looks

When you choose “Create Link” in the editor, we store the look (shader code, values, name and two preview images) under a random code at Netlify, so that you or others can open it through the link, for example on your Mac. Your own photos are never included: the editor replaces them with the sample image first. Anyone who knows the link can open the look; its name and preview image also appear in the preview when the link is shared in a chat. Links do not expire. We delete a link if you ask us to. When a link is created and opened, Netlify processes your IP address to limit abuse; we do not store it. The legal basis is providing the function you asked for (Art. 6(1)(b) GDPR) and our legitimate interest in protection against abuse (Art. 6(1)(f) GDPR).

Waiting list and emails about shadr for Mac

If you sign up for the waiting list, we process your email address and the language you chose to tell you about the launch of shadr for Mac. Sign-up uses double opt-in: you are only added after clicking the confirmation link. The time of sign-up and of confirmation and the IP address are stored to prove your consent. For the form and the emails we use Brevo, a service of Sendinblue SAS, 17 rue de Salneuve, 75017 Paris, France, as our processor. The legal basis is your consent (Art. 6(1)(a) GDPR). You can withdraw it at any time through the unsubscribe link in every email or by emailing us; we then delete your address from the list.

Beta test of shadr for Mac

If you sign up for the beta of shadr for Mac, we process your email address and the language you chose to send you emails about the beta, to ask you once how it went, and to send you your Pro key at launch. Sign-up uses double opt-in through Brevo, as for the waiting list. Answers to the survey reach us by email and are handled like feedback (see below). The legal basis is your consent (Art. 6(1)(a) GDPR); you can withdraw it at any time through the unsubscribe link or by emailing us. We delete the list once the Pro keys have been sent, at the latest three months after the launch. You redeem the Pro key with our reseller Polar; its privacy policy applies to that.

Feedback and problem reports from shadr for Mac

In the app, “Send Feedback…” lets you report a problem, send an idea or give other feedback. Nothing is transferred until you click “Send”. What is transferred: your message and the kind you chose (problem, idea, other), your email address if you give one for a reply, and, if switched on: system information (app and macOS version, Mac model, chip, memory, displays, language and your shadr settings; the app shows exactly what under “What Is Sent”), an image of what the wallpaper is showing, and the app’s own log messages from the last 10 minutes. In these messages, user name, full name, computer name, volume names and email addresses are made unrecognizable first; the app shows the log before sending.

The report goes encrypted to a function on shadr.treo.studio (Netlify; your IP address is processed to limit abuse) and from there is delivered by Brevo as an email to our mailbox at IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany. Brevo keeps delivery logs for a limited time. The purpose is to find and fix errors, improve the app and answer you if you wish. The legal basis is our legitimate interest in an app that works (Art. 6(1)(f) GDPR); if you give an email address for a reply, also Art. 6(1)(b) GDPR. We delete reports once they are dealt with, at the latest after 12 months.

Updates of shadr for Mac

The app checks for updates once a day and when you choose “Check for Updates…”; you can turn off the automatic check in the settings. For this it fetches a list of the available versions from shadr.treo.studio (Netlify). Your Mac’s IP address and the app’s version are processed; the app sends no other information about your Mac. It downloads an update from the same address, and only when you install it or have turned on automatic installation in the update window. The purpose is to provide you with fixes and security updates; the legal basis is our legitimate interest in a secure, up-to-date app (Art. 6(1)(f) GDPR).

shadr for Mac otherwise

The app has no account and collects no usage data (no telemetry, no crash reports to us). Settings, your own looks and images stay on your Mac. The app only connects to the internet when it checks for updates, when you send feedback or when you open a link (for example to the editor).

8. Measings

Measings is our easing library in the browser (measings.treo.studio). Like this website, it is hosted by Netlify (see section 2) and uses Pirsch (see section 3) to count page views. It sets no cookies and has no account. The easings you tune and your settings are stored in your browser’s local storage (localStorage). They do not leave your device and are strictly necessary for the function (Section 25(2) No. 2 TDDDG). You can delete them at any time in your browser’s settings.

9. Your rights

You have the right of access, rectification, erasure, restriction of processing, data portability and to object to processing based on legitimate interests. Just email us. You can also lodge a complaint with a data protection supervisory authority, for example the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (Kavalleriestraße 2 bis 4, 40213 Düsseldorf, Germany).
